Terms and conditions of use

General conditions and payment conditions for Automotive Literature Europe.  

Article 1 Relevance

1.1 These terms and conditions of use are applicable to all offers from AutoLit.eu Automotive Literature and on all agreements with Automotive Literature Europe as long as deviations from these terms and conditions are not specifically agreed upon by both parties.

1.2 If the Customer refers to his or her terms and conditions of use, those terms of use and condition aren't applicable unless this has been explicitly agreed to in writing by Automotive Literature Europe.

1.3 The terms and conditions of use can only be deviated from when explicitly agreed to in writing in which case the remainder of the terms of use are still applicable.

1.4 Upon acceptation of the offer or placement of an order you agree to the Terms and conditions of use and all other rights and obligations as mentioned on this site.

1.5 Under the term customer we count any visitor of the internet site and every person or corporation that has a contractual relation of any sort with Automotive Literature Europe.

1.6 Automotive Literature Europe has the right to change or add to the Terms and Conditions of use at any time. 

1.7 Automotive Literature Europe has the right to cancel any order without explanation, if the order form is not filled in complete or for other urgent reasons.

1.8 Automotive Literature Europe has the right to use intermediaries and other third parties during the execution of the agreement with the customer. These Terms and Conditions are still applicable.

Article 2 Offers & Agreements

2.1 All listings and offers of Automotive Literature Europe are without obligation and as long as it is in stock

2.2 Automotive Literature Europe has the right to change the prices at any time, particularly when the legal prescriptions demand this.

2.3 An agreement will be concluded at the time that an order confirmation is sent by email to the email address specified by the customer. The customer and Automotive Literature Europe explicitly agree that by usage of electronic means of communication a valid agreement is reached as soon as the Order confirmation is sent to the customer. The electronic files of AutoLit.eu Automotive Literature, as far as is permitted by the law, count as a presumption of proof.

2.4 Information, pictures, oral communications, by telephone or via email provided statements relating to all offers and features of the product are as accurately as possible given or done. Automotive Literature Europe however does not guarantee that all information given about products or offers are with full accuracy. Deviations or abnormalities are in principle no motive for compensation in case of damages or dissolution.

Article 3 Prices and Payment

3.1 All prices listed by Automotive Literature Europe in the webshop are in Euro ( € ), US Dollars ( $ ), GB Pounds ( GBP ), Yapanese Yen ( ¥ ), Swiss Francs ( CHF ). Inclusive of sales tax and shipping costs, unless specifically mentioned or agreed to in writing. We apply the margin scheme as sales tax and this is not on the invoice sent out to the customer.

3.2 Shipping costs are based upon current TNT-Post rates and are valid for shipment within and outside of Europa. For certain payment methods further conditions apply regarding the delivery method and shipping costs. This is clearly communicated to the customer.

3.3 Special offers are only valid for the period listed on the website in relation to that offer.

3.4 Automotive Literature Europe can not be held to her offer if the customer, within reason, fairness and general view, should understand that the offer or part of the offer contains an obvious mistake or error.

3.5 Offers do not automatically account for Backorders.

3.6 Upon ordering on our site the following payment methods are available: Payment in advance; the customer transfers the due payment including shipping costs to the following account: 3782.20.497 in the name of Automotive Literature te Haaksbergen. Referencing the order date and invoice number

Article 4 Delivery

4.1 Automotive Literature Europe has most articles in stock. Orders are delivered as soon as possible. With payment in advance we send the ordered articles every Tuesday and Friday after receiving payment. The listed delivery times are an indication and do not count as a deadline. Exceedance of any delivery period does not give the customer the right to damage compensation or dissolution of the agreement, unless the delivery period is exceeded with an amount where the customer can no longer fairly be asked to keep the agreement in stand. The customer is in this case responsible for cancelling the order and for the dissolution of the agreement as far as this is necessary.

4.2 In the case that an article is not in stock and is ordered by the customer, it will be indicated that the product is temporarily not eligible for delivery. The customer will be notified by Email of any delays.

4.3 Delivery takes place at the address given by the customer during the conclusion of the agreement.

4.4 Different policies may apply to deliveries abroad.

Article 5 Retention of title

5.1 Ownership of a product is given over to the customer when the customer has completed his or her agreement with Automotive Literature Europe. All risk regarding the product is given over to the customer at time of delivery at the specified address in the agreement. If the customer fails to accept the products at delivery then the resulting damage and costs are for his or her account. Costs regarding returning items to Automotive Literature Europe are on account of the customer and need to be sent pre-paid and with written explanation

Article 6 Swapping and Revocation rights

6.1 The customer must upon delivery closely examine whether the products meet the agreement. The Customer must take into account small size and color differences of the products shown on the websites. If the products do not comply with the agreement, the customer is required to notify Automotive Literature Europe as soon as possible and in any event within 14 working days after the delivery, at least after observation of the products was reasonably possible, in writing and with sufficient detail.

6.2 If it is shown with sufficient detail that the products do not meet the agreement, Automotive Literature Europe has the choice to replace the products with new products or refund the invoice value.

6.3 If for whatever reason you decide not to accept the products, you have the right within 14 days of delivery to return the products to Automotive Literature Europe. Returns in this case are only accepted if the products are not damaged or used.

6.4 If the customer uses the right as stated in the previous paragraph, Automotive Literature Europe carries the responsibility to refund the amount paid by the customer within 14 days.

6.5 The customer is responsible for any costs for returning the product.

Article 7 Warranty and liability

7.1 Automotive Literature Europe is never obliged to pay any compensation to the customer or others, unless there is intent or gross negligence on the part of Automotive Literature Europe. Automotive Literature Europe shall under no circumstances be liable for consequential or trading loss, indirect damages, and profit or loss of turnover.

7.2 If Automotive Literature Europe, for whatever reason, is required to compensate any damages this compensation will not exceed the amount equal to the invoice value with respect to the product or service that caused the damage.

7.3 It is possible that Automotive Literature Europe on its website links to another website that may be interesting or informative to the visitor. Such links are provided for informational purposes only, Automotive Literature Europe is not responsible for its contents or how this content may be used.

Article 8 Force majeure

8.1 In case of force majeure Automotive Literature Europe is not held to her responsibilities towards the customer, respectively the obligation shall be suspended for the duration of the force majeure.

8.2 Under force majeure we consider any of her independent circumstance, which results in completely or partially preventing her from fulfilling her obligations. Those circumstances include strikes, fires, business failures, power failures, no or non-timely delivery by suppliers or other third parties and the absence of any Government to obtain permit. Force majeure is also understood to mean interference in a (telecommunication) network, connection or communication systems that are in use and of the at any moment inaccessibility to the website.

Article 9 Intellectual property

9.1 The customer acknowledges that all intellectual property rights of displayed information, images, communications or other expressions with respect to the products or related to the website owned by Automotive Literature Europe, her suppliers or other copyright holders.

9.2 Understood under intellectual property is patent, copyright, trademark,, designs, rights and other (intellectual property) rights, including whether or not patentable technical and or commercial know how, methods and concepts.

9.3 The customer is prohibited from using, including making changes, of the intellectual property rights as described in this article, such as reproduction, without the explicit written permission of Automotive Literature Europe, her suppliers or other claimants, unless it is for private use in relation to the product itself.

Artikel 11 Applicable law and jurisdiction

11.1 On all rights, obligations, offers, orders and agreements upon which these Terms of use and condition apply, including the terms of service and use, is exclusively the Dutch law applicable

11.2 The relevance of the CISG is exclusively excluded

11.3 All disputes will be brought before Dutch jurisdiction

Artikel 12 Miscellaneous

12.1 Automotive Literature Europe is based in Enschede, the Netherlands. And is registered with the Chamber of Commerce under nr. 08215544. The VAT identification number is NL101703831B01

12.2 Please send all Correspondence to Automotive Literature Europe. Postbus 487, 7500 AL te Enschede, the Netherlands. Or to the e-mail address as mentioned on the website.

12.3 If the terms of use and condition are changed during a short or longer period of time, Automotive Literature Europe is still allowed to demand direct and strict compliance of these terms and conditions. 

12.4 Every image on our website is the property of Automotive Literature Europe, copying is allowed when there is a citation to our website Autolit.eu. If you do not comply to this, then we regard this as a violation of our copyright, after which we will charge a 250 euro fine per image used. The pictures used will also have to be removed.

It may of course happen that you have a complaint, you can always send it to info@autolit.eu. If you are unable to resolve the complaint this way, it is possible to register for mediation with WebwinkelKeur foundation, via https://www.webwinkelkeur.nl/kennisbank/consumenten/geschil Complaints can also be reported to the ODR platform of the European Commission, which can be found at: http://ec.europa.eu/odr.
If your complaint has not yet been processed anywhere, you can submit your complaint via the European Union platform.
